1. About these terms

These terms govern your use of the websites operated by MovarOS PTY LTD (ACN 678 781 523) (“MovarOS”, “we”, “us”). By using any of these websites, requesting a quote or contacting us through them, you agree to these terms. If you do not agree, please do not use the sites.

2. Which websites these terms cover

  • swiftcargo.solutions — Swift Cargo Solutions
  • expatsdirect.net — Expats Direct, including its white-label deployments
  • swiftpets.co — SwiftPets
  • swiftpetflights.com — Swift Pet Flights

All of the above are operated by MovarOS PTY LTD. Where a site publishes its own terms of service or service-specific conditions, those apply to services booked through that site in addition to these terms.

3. Using our websites

You agree to use our websites lawfully and not to:

  • Submit false, misleading or fraudulent information
  • Interfere with, disrupt or attempt to gain unauthorised access to the sites or their systems
  • Use automated means to scrape, harvest or collect data from the sites without our written permission
  • Use the sites to transmit malicious code or unlawful material
  • Infringe the rights of any other person

4. Quotes and estimates

Quotes, estimates and indicative pricing shown on our websites or supplied in response to an enquiry are estimates only and are not a binding offer. They are based on the information you give us and on assumptions about volume, weight, route, dates, access, documentation and applicable duties or charges.

Final pricing is confirmed in writing before a booking is accepted, and may change if the actual circumstances differ from the information provided, or if third-party charges, carrier rates, taxes or regulatory requirements change.

Nothing on our websites constitutes advice on tax, customs, immigration, quarantine or legal matters. Where we provide general information on these subjects it is for guidance only, and you should obtain professional advice for your circumstances.

5. Fulfilment partners

Services enquired about through our websites may be delivered by MovarOS or by a fulfilment partner within our network, including movers, freight forwarders, pet transport operators, airlines and destination agents. Where a service is delivered by a partner, the terms of carriage or service conditions of that partner will apply to the physical performance of the work, and will be made available to you before booking.

6. Communications

By submitting an enquiry you agree that we may contact you about that enquiry using the details and channels you have provided, which may include telephone, email, SMS and messaging applications.

Where you have consented to SMS, message frequency varies and message and data rates may apply. You may opt out at any time by replying STOP, or reply HELP for assistance. Opting out of SMS does not affect your quote or booking, and we will continue to contact you through your other chosen channels where necessary.

7. Intellectual property

All content on our websites — including text, graphics, logos, brand names, images, software and page design — is owned by or licensed to MovarOS PTY LTD and is protected by intellectual property laws. You may view and print content for your own personal or internal business use. You may not otherwise copy, reproduce, republish, adapt or commercially exploit it without our written permission.

8. Third-party links

Our websites may link to third-party sites. We do not control those sites and are not responsible for their content, availability, or their privacy and security practices. A link does not imply endorsement.

9. Availability

We aim to keep our websites available and accurate, but we do not warrant that they will be uninterrupted, error free, or that the information on them is complete or current at all times. We may change, suspend or withdraw any part of a site without notice.

10. Liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

Subject to that, to the maximum extent permitted by law:

  • Our websites and their content are provided on an “as is” basis without warranties of any kind
  • We are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, data or business opportunity, arising from your use of our websites
  • Where our liability cannot be excluded, it is limited to resupplying the relevant service or paying the cost of having it resupplied

11. Indemnity

You agree to indemnify MovarOS PTY LTD against any claim, loss, cost or liability arising from your breach of these terms, your misuse of our websites, or your provision of false or misleading information.

12. Changes to these terms

We may update these terms from time to time. The current version is always published at this address with the effective date shown at the top. Your continued use of our websites after a change takes effect constitutes acceptance of the updated terms.

13. Governing law

These terms are governed by the laws of the State of Queensland, Australia. You and MovarOS PTY LTD submit to the non-exclusive jurisdiction of the courts of Queensland and the courts competent to hear appeals from them.
